Kulmbach drug trafficker gets another chance to prove himself

The defendant is alleged to have trafficked in narcotics mainly with underage "customers" have operated. In the end, however, the 24-year-old got off lightly, i.E. A custodial sentence, of which. One year and nine months was the sentence handed down by presiding judge michael eckstein after a hearing lasting just under five hours. The sentence was suspended for three years on probation. The decisive factor for the lenient sentence was that the young defendant had otherwise completed an orderly life, from graduating from school to completing vocational training. He had not yet come into contact with the law and was fully confessed.

As prosecutor daniel gotz reported from the indictment, the defendant was engaged in a large-scale trade in narcotics in the kulmbach area at the end of 2016 and the beginning of 2017. He did several drug deals with 15- and 16-year-olds, sold marijuana in small quantities for at least 10 euros each in at least three cases. At the beginning of february, the young man from kulmbach, germany, smuggled 90 grams from a hashish plate, which he had previously bought in bayreuth for 900 euros. He used 15 grams of hashish for his own consumption, the rest of the narcotics he doped for 15 euros a gram.

The most serious incident for the defendant was an alleged drug trip to bamberg. With a 16-year-old at the time of the crime, he agreed to travel to bamberg to purchase around 250 grams of cannabis products for 1400 euros. With only 900 euros, they set out on the journey, but the drug deal did not come off because he was attacked by several people at the destination. So the accused drove back without the drug, but with a good beating and the cash.

During a search of the apartment on 21. February, it was also established that the accused was growing four cannabis plants in a self-built facility. In addition, narcotics and cannabis seeds were found in the apartment. Prosecutor daniel gotz: "the accused knew that in all cases he did not have the necessary permission for the handling of narcotics. He knew that the persons had not yet reached the age of 18 at the time of the crime. Had reached the age of 18.

Judge michael eckstein took a lot of time to examine the personal circumstances of the defendant in detail. He also came to the conclusion: "the defendant has in itself completed a proper way of life. But then he lost his way, because the family connection was also missing." A decisive break in his young life was probably the divorce of his parents. For a long time he lived in a shared flat, which was not necessarily advantageous for his further life.

He did not make any gross profits with his crimes. In the questioning of the accused it also became clear that one or the other drug trafficker behaved differently than presented. Once he only served as a contact person, which also came to light during the interrogation of five young witnesses, all of whom are also known in the drug milieu of kulmbach and have already been convicted.

In his plea, prosecutor daniel gotz made it clear that it was really only a question of whether or not the defendant would be sent to jail. Gotz was initially of the opinion that there was no way around prison. In the end, the prosecutor pleaded for a lighter sentence, especially since the defendant showed himself to be reasonable. Defense attorney and lawyer frank stubinger pleaded for a suspended sentence of one year and nine months.

In his last words, the defendant ruefully stated: "I have learned a lot from this. I have ruined so much for myself and many friendships have also been broken. I have made a hell of a lot of mistakes that are also serious for me. I swore i would never have anything to do with drugs again."
